TERMS OF SERVICE
Please read these terms carefully before purchasing any service. By engaging my services, you agree to the following terms.
1. Services Offered
I offer software engineering services including but not limited to: front-end web development, full-stack application development, cloud architecture, AI integration, codebase modernization, MVP development, DevOps setup, bug fixing, and technical consultation. All services are provided on a project basis unless otherwise agreed.
2. Pricing & Payment
All prices are listed in USD. Payments are processed securely through PayPal. For projects under $500, full payment is required upfront before work begins. For projects $500 and above, a 50% deposit is required to begin work, with the remaining 50% due upon final delivery and client approval.
Add-on services are billed separately and discussed during the project kickoff phase. Custom or quote-based services are scoped and priced after an initial consultation.
3. Add-Ons
Add-on services (extra revisions, extra pages/sections, DNS + Deployment, Priority Delivery) are available to extend any applicable tier. Add-on availability depends on the selected tier — not all add-ons apply to every tier. Add-on pricing is listed on the Services page and is subject to change. Priority Delivery is calculated as +25% of the tier price and reduces delivery time by approximately 30%.
4. Revisions
Each service tier includes a specific number of revisions as listed on the Services page. A "revision" is defined as a reasonable change to the existing agreed-upon scope — not a redesign or addition of new features. Additional revisions beyond the included amount are available at $30 each. Each additional revision adds approximately 1 business day to the delivery timeline.
5. Delivery Timeline
Delivery timelines listed on the Services page are estimates based on standard project scope. Actual delivery may vary depending on project complexity, client responsiveness (e.g., providing content and feedback), and any additional work requested. I will communicate any expected delays promptly.
6. Client Responsibilities
The client agrees to provide:
- Clear project goals and requirements
- All necessary content (text, images, branding assets)
- Timely feedback on deliverables (within 3 business days)
- DNS/domain access for deployment (if applicable)
Delays in providing the above may extend the project timeline. If a client is unresponsive for more than 14 consecutive days, the project may be considered abandoned, and no refund will be issued for work already completed.
7. Intellectual Property
Upon full payment, the client receives full ownership of the final deliverable (source code, designs, assets created specifically for the project). I retain the right to showcase the project in my portfolio and case studies unless otherwise agreed in writing. Third-party assets (fonts, stock images, libraries) remain subject to their respective licenses.
8. Warranty Disclaimer
All deliverables are provided "as-is" upon final delivery and client approval. I do not provide warranties — express or implied — regarding fitness for a particular purpose, merchantability, or uninterrupted operation after handoff. I ensure quality and functionality at the time of delivery, but ongoing performance depends on the client's hosting, third-party services, and any modifications made after delivery.
9. Limitation of Liability
I am not liable for any indirect, incidental, or consequential damages arising from the use of deliverables. My total liability is limited to the amount paid for the specific service in question. I do not guarantee specific business outcomes (e.g., revenue, traffic) from the delivered work.
10. Termination & Cancellation
Either party may terminate the project at any time by providing written notice via email. Upon termination, the client is responsible for payment for all work completed up to the termination date. See the Refund Policy for details on refund eligibility.
11. Force Majeure
Neither party shall be liable for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to: natural disasters, internet outages, government actions, pandemics, or third-party service failures (e.g., hosting provider downtime, payment processor outages). Affected timelines will be extended by the duration of the event.
12. Confidentiality
I agree to keep all client data, business information, and project details confidential. I will not share client information with third parties without explicit consent, except as required by law.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Philippines. Any disputes arising from or relating to these terms or the services provided shall be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to the appropriate courts in the Philippines.
14. Changes to Terms
I reserve the right to update these terms at any time. Changes will not affect projects already in progress — only new engagements entered after the update date. The current version is always available at this page.
